1. Policy Statement

Billy Button Babysitting (“the Company”) is committed to maintaining the privacy, safety and dignity of all clients, children and staff. To ensure consistent operational standards and to protect the legal and practical functioning of our services, the Company does not enter into, review, negotiate, or sign individual Non Disclosure Agreements (NDAs) or confidentiality contracts requested by clients or third parties.

This policy applies to all bookings, including but not limited to:

• Group babysitting sessions
• Private or one family bookings
• One off, casual, or ongoing care arrangements
• Events, functions, and multi‑family engagements

2. Rationale

The Company’s refusal to sign NDAs is based on the following considerations:

2.1 Operational Incompatibility

NDAs typically impose broad, complex and ongoing confidentiality obligations that are not compatible with the nature of childcare /babysitting services, which involve:

• Incidental observations within a family home
• Interaction with multiple individuals
• Mandatory reporting obligations under NSW law
• Standard record‑keeping and safety procedures

2.2 Group Booking Constraints

Where multiple families are present, it is not feasible or equitable to impose individualised legal obligations on the Company, its staff or other participating families. Group environments inherently involve shared spaces and shared interactions.

2.3 Legal and Regulatory Obligations

The Company must comply with:

• Child protection legislation
• Mandatory reporting requirements
• Workplace health and safety obligations
• Insurance and record keeping standards

Entering into private NDAs may conflict with these statutory duties.

2.4 Existing Privacy Protections

The Company already maintains strict internal privacy and conduct standards, including:

• Professional discretion by all staff
• Non disclosure of personal information to third parties
• Prohibition on sharing photos, videos, or identifying details without consent
• Secure handling of client information

These protections apply uniformly to all clients and render additional private NDAs unnecessary.

3. Alternative Arrangements

Where a client requires heightened privacy or discretion, the Company may, at its sole discretion, offer:

• A private, one family booking
• Clarification of privacy expectations within the Company’s standard service agreement
• Assignment of a dedicated sitter for ongoing arrangements

Such accommodations must remain consistent with this policy and with the Company’s legal obligations.

4. No Exceptions

The Company will not:

• Sign NDAs drafted by clients or third parties
• Modify or negotiate its standard privacy terms
• Accept liability arising from external confidentiality agreements
• Permit staff to sign NDAs in a personal capacity

Any request for an NDA will be declined in accordance with this policy.

5. Acknowledgment

By engaging Billy Button Babysitting, clients acknowledge and accept this NDA Policy as a condition of service. Continued use of the Company’s services constitutes agreement to the terms set out herein.
